Sorry to just be responding now, but I've been out. My picture is still on her site. Maybe she's out of town or something? I really am trying to be patient and am more disappointed than upset about it. I DO take it as a compliment that someone 'borrowed' my cake picture, but at least give me credit!

Turns out she's a CC member, which is so disheartening... I guess it's a good way to get pictures for your business? icon_confused.gif

Anyway, I want to thank all you guys for the kind words and support. THAT is what I have come to expect from CC, and the actions of one will not change that.

So to water mark my photos already posted would I have to mark them and then upload them all again? I've thought I ought to use a watermark but not sure how.

Yes you would have to water mark them and upload again. I am not sure how its done and my sister is in Canada right now. When she gets back in September she will do my photo's for me. Sorry I could not be of more help

if she's a member here, anyone know what her screenname is, i want to see what kind of cakes she has uploaded here. i assume that if she is lying about her cake pics, she is lying about her credentials and lying about the amount of business she does. i think she is trying to make her self seem much more established than she is. what real business could afford those prices? and if she is making that many cakes at a time she has to have other people working with her and for what she sells the cakes for there must be just about nothing to split with them, maybe she is running a cake decorating sweatshop. icon_razz.gif

That's exactly what I was thinking. Perhaps she's not that talented. Perhaps none of those pics are hers. Perhaps her work is not all that spectacular and that's why she only charges $1.95.

Geesh - why can't people just be honest???? And, this person needs to employ a proofreader or grammarian to edit her bio - famous chefs are "renowned" not renown!!!!! By the way, the cake with the wedding dress is really gorgeous! PAT

well as for as charging. Killen is not that big and mostly its a military base. saying that, i also charged less than $1.95 a slice. like somone else said it all depends on were you live. and i happen to live on an military base out the country.
i have more pics on my website.... So just because she charge what she charge, that doesnt mean anything...

The web site notes in the pricing page that: "each cake is unique to your specific needs."

This is a very sad thing.

I have used many places for inspiration and always tried to change something on the design so I am not just copying it and I always keep notes on where I got the inspirations so I can go back to it later and or give credit when I need to.

I am so sorry that this has come up, I remember another post within the last few months involving My space...

I do not understand why people have to steal when they could ask to borrow the picture and if they cannot, then they could do their own and at least change it a bit. There is no need to make it exactly the same.

What are we teaching our children if we let this happen.

I am sorry that your going thru this, Its always very difficult when something like this happend. Is not that your mad that she took the pic is the FACT THAT SHE DID NOT ASK NOR GAVE CREDIT WHERE CREDIT WAS DUE.

That most likely means she came to Dallas for the Cake Carousel class a couple of months ago.
This keeps happening, and it really annoys me. I just don't understand why people don't stand on their own work. It is a complete misrepresentation of what they are capable of to their clients.

Ok.. call me ignorant.. but how do you guys know for certain that these are your cakes. Could she not have recreated the same cake? ie the cheeseburger thread. And how would one prove that it is their cake? Not that im condoning this behavior however, it is possible that they are recreations vs a stolen image.

It is the exact same photograph, not a recreation of the cake.

an easy way to tell....

look at the background.

now, unless she has the exact same furniture, fabrics, lights, etc. all placed exactly the same .....then it's not a duplicate but plagiarism.

and even if she did a cake on a neutral, say black background, every decorator has a unique "signature" if you will that's very hard to duplicate.

and if had the time to create transparencies of the cakes in question, could easily overlay them to see how much of a match they are.

I'm inclined having viewed the site and the individuals cakes in question to say......

PLAGIARISM!!!!! (and in schools that earns an F and if found out on the part of a college prof or administrator -- gets that person fired! --- and according to copyright law -- it's theft (image is copyrighted property -- the picture, not the idea)

If you emailed her at the address on the site, she may not check business email over the weekend (notice the business hours are only Tues-Fri and Sat by appt only)...or tis true it's vacation season, some people may be gone for 1-2 weeks at a time. Be patient while you wait to reach her, I remember last time this topic came up the person involved had not received the emails over the weekend, by the time she heard about what was going on there was a raging firestorm of people ready to lynch her not just due to the pics, but due to the fact that they hadn't heard a response yet.

Regardless, they need to come DOWN! It is really amazing that people dare to do that...and if the pics are put up by their site designer without their permission (I know, I know - let's not go there! Seriously!) it makes no sense whatsoever that the person doesn't try to rectify it right away. If they can't get their website edited, the least they could do is email the CC community and say "I'm so sorry but your pics were put up on my site, I don't know whose pics they are so I can't PM you personally, but I'm trying to get them removed." I think that's why it's so easy to assume that it's not an honest mistake - you'd expect someone who made an honest mistake to do whatever they could to fix it. (Ounce of prevention=pound of cure ya know?)

These pictures are exactly the same. (The one on the website and the one on the authors of this posts pics) If it were me and it never will be, hahahahaha, I would be flattered if they chose it as a style to recreate for their customers. But that isn't what happened. . .the photo was simply hijacked. This is our form of art. It's like me taking a Picasso and saying. . ."Look what I did!". This is not a good business practice. If I were you i would contact the owner of the site and nicely ask that she either remove the photo or give you credit for it after all, it is your photo of a cake YOU made. It is a beautiful cake.

This is an interesting thread discussing the "new member bashing" thread you're referencing. That thread was actually locked and then deleted by a moderator for several reasons (see p. 3 of the link below), including that the alleged photo hijacker had been receiving harassing phone calls from CCers.

In that thread you'll see that the CCer using other's photos "realized that the person who created the website for them used the wrong photos and the issue was immediately rectified." I'm not gonna go there with that explanation; regardless of the explanation, the moderator points out that the issue WAS indeed rectified (I know, actually you said this has happened before...grr.).

This topic is absolutely fascinating to me so I'm putting this out as a warning in hopes things will stay nice (like they always do right?!) and this thread won't get locked. I'd really like to know what happens and if the problem is resolved!

I'm not upset about it, but AM surprised and disappointed. To think that a fellow CC'r would do that shocks me.

I never meant to bash her or anyone else, nor do I want anyone else to turn this into something it isn't. My post began and remains as I put in the subject, as a WARNING to others in case their cake is on her website too!

im not taking any sides.. but everyone should be fair and human about it. There is the possibility that the PHOTOGRAPHER sold his photo and it was purchased... in that case ANYBODY could use it. You know unless you copyrite a photo, though its rude, it is fair game. just because you can use a picture doesnt mean you should. Water mark your stuff as posted earlier... ?? Mabey you should take it as a compliment.

Just to address the point coldtropics brought up - I made the cake, I decorated the cake, and I took the picture. Then I posted it here on CC as I do from time to time.

When I discovered my cake picture on her website, I emailed her and am waiting for a response. I figure if I do not hear from in the next few days, I will be calling the number she has posted.

oh.. and i looked at the site... she has photos listed under "ideas" not hey look at my previous work. But to be honest the presumption is that photos in a gallery are that confectionists work... but how do any of us know? Martha stewart certainly isnt making most of the crap in her book/mags... but noone questions that.

1. Audrey took the photo and owns the copyright. You do not have to do anything special to place a copyright on a picture -- if you created it, you own it.

2. The picture is under 'Portfolio' which specifically means that it is a work of the artist in question.

No, Martha Stewart does not personally make everything herself, but anytime I've ever seen a cake pictured in any of her magazines, the artist has ALWAYS been given credit somewhere on the page!!!

Oh I am totally with you on that, I hope you don't misunderstand me (although a previous poster did sort of sling an arrow at her). I think every time this happens you (ie whomever this happens to) should totally post about it. Whatever the reasons are for these pics getting on peoples' sites, innocent or not, it's dishonest to leave them there. Totally with you all: copy a cake=ok. Steal a photo=not ok.

I just figured I'd put that thread out there so that things STAY nice icon_smile.gif. Since I was watching that other thread last month that got locked. I hate it when that happens!
