Can I Get In Trouble For Selling Cakes Even If I Don't Take A Real Profit?

Hello there,
I live in Ontario, Canada and I have been cake decoarting for family and friends for years since I was a Baker for 5 years and decided to go into a different career for my full time job.
I have always baked out of my home, and I consider it a hobby, but I do ask people for money to cover the costs of the materials (because otherwise I would go broke and I just want the opportunity to make then). And if I ever make money due to tips or sales I didn't know about, I put that right into some more equipment to make my cakes.
However, a friend told me I could still get in trouble because I am asking money from people, regardless if I don't make a profit.
However, I have looked into making it a legal business before, but I definitely can't anytime soon because I rent and have no way of using a commercial kitchen to be licensed (they charge stupid price for kitchen rentals and I wouldn't get orders charging higher, because as I said it isn't about making money for me).
My question is in a nutshell, do I have to stop asking people for money for the materials when making my cakes to keep from getting in trouble? Or should I be OK since I am not in it for a profit?

Contact your local Health Dept. Some places use the Ag dept. You have to find which is in your city, county, country. They can all be involved somehow. Years ago I lived in CA followed their rules only to find out that not only did the county have different rules/laws, so did the town fathers ( So I had to adjust to the town rules not the state or county. You have to do the research for where you live.
