I bake out of a commercial kitchen, but when I was baking at home I asked lots of people for advice about becoming "legal". (I am also in VA). Every person I talked to from the government to accountant friends, told me to fly under the radar and forget about it. Not one person told me to get a license, FEIN, or an inspection.

I have all of those things now, but if I'd listened to advice, I wouldn't have gotten them.

Oh my God...It's amazing what bad advice you get when you're trying to do things the right way. I bet that if you had gone under the radar and then were found out, not one of the people who told you not to bother getting licensed would have backed you up, either.
