I know everyone is SICK of legality questions, but can I make Hello Kitty cookies legally? If not, does anyone know of any good ideas on how to do cookies that aren't Hello Kitty, but look like it?
Not legal, but since she's just a white cat, I would think you could easily just make white cat faces, maybe give her a heart nose instead of the yellow circle..or something like that to make yours unique. You could make the bow or bow placement different too. Just guessing.. good luck!
it doesn't take much to make it not a legal issue just like elvis said just change a little something then wa lah it is yours!
Thanks!
I'll propose that to her and see what she thinks....
I have made few Hello Kitty cakes (but for family or a friend). If you propose anything to her, make SURE it's just a white cat....nothing even remotely similar to Hello Kitty. If it's a likeness of the copyrighted image, it's illegal....in other words, if someone looks at the cake and says "oh, it looks like Hello Kitty", that's a legal infringement! In the past I've done character cakes (and even sold them), but I've moved away from that unless it's for a niece or close friend where no $ was exchanged.
I'm sure she'll like a white cat all the same!
Well, technically, we're getting into trademark infringement issues here. Like cambo said, if you look at it and think "oh, it looks like Hello Kitty" you're in trouble. With a different nose and a bow switch you might be doing enough to avoid copyright infringement, but you're still on the hook for the trademark.
You don't have to register a copyright to own it--you own a copyright from the moment of creation. But you do have to register a trademark and the rights granted to a trademark owner are more broad than the protection covered by copyright.
