I stopped down at the village bldg today - yes, VILLAGE, it's that freaking small here. They said "If you are doing onesies and twosies, go ahead and sell some cakes, we don't care. If you start getting industrial equipment, then talk to one of the restaurant owners and they can tell you who to go through because then you will need a state license." icon_confused.gif

So, if I use just the KA, I'm fine? Interesting rules, but it fits with the rest of the way things go out here in BFE. The next "town" over said the same thing - we can even advertise our other business there (computers), but not on the highways because then we have to get DoT approval.

So, is this like a cottage biz law that's not on the state books? State said not from home except for x,y,z. I plan to sell only "non-hazardous" goods, ie nothing that needs refrigerated, which falls under the exemptions.

I'm confused.

It sounds to me like you are very lucky! If it were me, I would just make sure that I had the name and number of the "informant" in the village ( icon_lol.gif ) and get baking!

I am not so sure. Check with your state first, not your town. My town said I could sell cakes from my house, but the state said "NO." You have to remember to follow all the rules, town and state. Here is a post that may help you with what you have to do for Wisconsin.

Hope this helps. I just do not want you to get in trouble if you think you are licensed and the government comes after you. Read what TSCookies wrote about.

There is always that...

I only bake for family birthdays now (16 total/year) plus gifts for neighbors or friends. Haven't sold anything, actually turned down biz because of the licensing thing. I was just wondering at all because my landlords asked if I could do a few cakes, and I WILL NOT do those for free! I figure they get money each month and know where I bake, ya know? But, I really don't want to take money if I'm not legal. Man, I would like to, though. Sure would help with rent! icon_lol.gif

I know that here in Minnesota that we can do cakes but cannot advertise. I have a gallery site but no pricing info of phone numbers and such. I aslo state that it is a gallery site for looking at my "hobby". You need to call your department of agriculture. Even though the city may say yes the state may say no.
Now if you are just doing low key for friends that really is not a problem in my mind.

Over 21??? Such a PERSONAL question! But, hey, born in the 1970's icon_wink.gif

There's only one other woman in the village who bakes, NO bakeries even at the grocery store!

Still wouldn't do a lot of cakes.. holding out till I get the new kitchen my FI keeps promising when we buy a place.

ANYONE can find out the requirements they are looking for by calling their county Health Department. If they are not the lisencing entity you need they will refer you to exactly who is. When you find out "who" you should be dealing with...call and ask for them to send you a packet in the mail. Also, you can call and ask to speak with an inspector who will answer ANY pertaining questions you may have. That is also part of their job!
