Nope. It possibly isn't and it is not my place to judge Paul as to the legality of these pics.
Not everyone watches AoC ... amazing, but true. IMO, anyone who doesn't watch the show is very likely to look at the gallery and think they are all "Paul's cakes."
How do you know they aren't all "Paul's cakes". Are you judging this based on what you saw from the show?
If so that's a pretty flimsy stance because hours of taping end up on the cutting room floor that we never see. Many people touch most of those cakes and we never know it because we never see it.
How often has it been said on the show "we all had a part in this cake" but it never shows every single person working on it.
And if someone orders a cake from JCC, because of a picture in that gallery, and doesn't get what's pictured... will it reflect badly only on Paul? I don't think it will. I think it has the potential to reflect badly on all of us (especially Duff and CCC, since they are mentioned by name on the JCC site).
If they don't watch AoC then how would they know it was a Duff creation or related to CCC, they wouldn't so he wouldn't take the fall? They wouldn't because his site doesn't say what cakes are CCC and which ones aren't.

Is it really acceptable to leave a job, even on good terms, and start your own similar business, using pictures of products made at your former place of employment?
It is absolutely acceptable as long your former employer said you can use their photos.
I left my business 5 years ago and my last day they gave me a gift of a portfolio. In it was a picture of cake I had worked on if/when I needed it in my new location.
In the back was a package of every kudo letter that had been written that had my name mentioned in it (with the letter writers permission for duplication for me to use) in the event I needed it for employment refrences.
These were the shop owners legal pictures and letters. She gifted them to me as a legal user of her work and documents.
I'd have thought that answer would be no, unless of course, you could and did establish that it was your work and that you had permission to use the images. But maybe that's the case only if you aren't on tv.
Maybe he has this proof and it is not up to him to prove it to the public??
Seriously, I doubt someone of Paul's calibur is going to play dirty and steal pictures from Duff especially since they know each other well.
If he did this and is playing dirty then we have a Cakegate on our hands! Who wants to be the modern day Alfred E. Lewis?

For me on this thread there is a difference as in the others that have come up.
It's being assumed/insinuated/discussed that Paul stole Duff's pictures. We have no proof.
Most of the recent threads where it was being discussed it was proven and posted by the photo owner who posted at CC and we had proof it was a stolen picture since the photo owner verified it.
I feel like Paul's being accused unfairly because we have absolutely no proof other than judgements and assumptions and with the amount of people who lurk here it could ruin his reputation.
It's a very fine line we are walking on this in my opinion.
I pray that non of you e-mailing Paul on this said that you are from CC. Especially since Duff has been so kind as to link to us on the website. I'd hate to have Paul upset if many people from here bombard him with e-mails over this and mentions it to Duff who in turn removes us from his site.

I would hate to upset Paul and Duff over something like this when it really isn't any of our business in the first place. It's a matter between Paul and Duff and not CC since there are no CC members photos on his site. We are only armchair quarterbacking this.
When we start e-mailing the "offender" (and posting on sites like the last time this issue was being discussed) it could put Heath/Jackie in a very sticky situation, and one that can turn into a legal night mare for them in many ways. That is a position we should never EVER put them in.
Health/Jackie, if my statements crossed the line I apologize but I just don't want you guys getting any business/professional relations or your reputation ruined over something like this and I just wanted to get what I had to say off my chest.

I think part of the reason for them not being interested in franchising was that the lady inquiring was talking about a franchise out of the country also (in Dubai).
Besides, I think Duff and his current staff "have it in" for someone else, not Paul. Did anyone else notice how much of a resemblance there was between the cake (Jason having his brain eaten by zombies) on a recent episode and Mike McCarey of Mike's Amazing Cakes? Hmmmmm......

Yes I do have Duff's permission to use those pictures on my web site.
For the most part the cakes you see on my site are ones that I either
built myself, had a hand in, or can offer up. Some of the shots were
using my cell phone camera, thus the low quality of some of the shots, and
some are with a better camera. Duff was very generous in allowing me
to poach some of the pictures off his site which makes it possible to
show what I can do without going to the expense of building a "dummy"
cake and taking a picture. It was an absolute blast working with Duff and
the crew at Charm City Cakes for the time I was there. I learned a
lot and discovered that I really like the extreme cake thing, thus my
move back home to Seattle to do Jet City Cakes.
I hope that sates your curiosity for now. Feel free to shoot me any
questions you might have. I am always happy to answer a question or
start a rumor.

It's a VERY big difference if the original designer, baker, creator has proof and post their findings, than some bystander finding the pictures by happenstance.
The next time we find something like this, and we are very concerned, call or write the person that would be affected first.

I really appreciate you all, especially KellJ, piping up (get it?) about the lack of photo credit on my website. When I got the email I was wondering if you all missed the text at the very beginning of the gallery stating that Duff had given me permission to use any photos from his site. Then I remembered that we recently upgraded the gallery software so I looked and, DOH, the credit was no longer there. That has now been remedied. Nice to know that there are nice folks out there watching out for Duff and anyone else that might be getting poached. A ton of work goes into these cakes and we should be giving credit where due.
For the record, the only things on my site that I did not actually touch are the football cake, the KISS Cake and the PS2 controller cake but I have built things that were very similar but we didn't get a picture. Duff encouraged me to grab some shots to get my gallery going but you'll notice that some of the pictures aren't exactly what you see on the Charm City website. I just took a picture with my phone before I left that day. Neat huh?
You are absolutely right about the editing on the show. Rarely is a cake done completely from beginning to end by one person. For example, the Pirate Ship I did was mine "from beginning to end" and I did do most of the work but Elena jumped in and did the island and treasure chest, Katherine did the sails and Camille did all the little cats and rats. It was very much a fun team effort to get 3,472 cakes out in one week!
Anyway, I am glad I finally found this forum and had a chance to say Hi and Thanks! Keep up the gossip and if you are ever in the Pacific Northwest and need a crazy cake, you know where to go.

I was reading all of this and wondering why does it matter to the Original poster what anyone else does as long as it doesn't directly effect them... but then I see that Paul came here and posted himself which I think is just great!
I think the fact that some of the pictures are lower quality then the others should've told you all (all those questioning things) right there that he took those himself or were taken with a different camera then the one used to take pics for Duff's website.
I think the similarity in the company names is nothing more then a friendly show of how much Paul appreciates all he's learned from Duff and working at CCC and seeing as CCC is here in MD and JCC is way on the other side of the USA literally.. there is no need to rant about the similarity.
I also think Duff would've been one of the first to know about this if permission wasn't granted to begin with. I'm sure he keeps tabs on his interns and past employees regardless of their reason for leaving the company.
Even if Paul was posing as something he's not, or "stealing" Duff's pics and taking credit for stuff he didn't do... in no way shape or form does that effect US... it effects Duff, Paul, CCC, JCC, and customers of JCC. No one else.
I also agree that there are better things going on in this world that should get heated over, not someone branching out and starting his own business at something he loves to do.
Seems like it's a bit of jealousy to me. JMHO
