Cake Licensing Question

I would like to find out why bake sales like for churches, schools, etc...do not have to be licensed to have bake sales..why arent those inspected but yet we have to be licensed at home to bake for a friend and get paid for it...
i want to do this for fun right now not as a business but i am worried about getting caught..that is my worst fear...especially if i make somebody mad...
husband told me to just only get the money for the supplies of the cake and dont make a profit as long as im doing it for a profit...do it for "practice" only..
any comments for this?
if you get paid even for supplies its still considered compensation and is illegal. maybe because churches and schools are non-profit orgs? thats just a guess on that one...
possibly but where my daughter does cheerleading at also had a bake sale..they arent non profit...i dont understand how some places have bake sales but we cant...
the brownies and cakes and stuff still have to be baked and they are being baked in homes...why arent those cakes, brownies, cookies, etc..being inspected?
The rules differ from state to state and county to county. In some places you cannot hold a public bake sale, or even bring birthday cupcakes to your child's class at school.
i dunno but i just was told that in the state of alabama that you had to be licensed...so was just kinda curious about this information and why they could do it but home decorators cant

Bake sales, generally, have an exception. It is presumed that the buyers are members of the group. If your office had a bake sale to raise money for whatever, it is assumed that only the people in the office would purchase stuff. Our county office requires a sign be posted in any public place where 'outsiders' might purchase. the sign says clearly there has been no health inspection and consumers buy at their own risk.
Trading goods or money inexchange for cake is considered a sale. Barter is also considered a sale. many decorators don't worry about the risk. You are baking for work, with a manager that may take offense. I would be extremely careful.

I'm also in Alabama and my County Health Dept. told me I could bake at home and be reimbursed for ingredients but not for profit. It can only be done for family and friends and you're not allowed to advertise, only orders by word of mouth.
But when you do a bake sale as a fundraiser for an organization, you have to have a card attached with ingredients listed.
I can't answer you question about why bake sales don't have to be inspected.

ohok..im in mobile....tried to call the health dept here yesterday but they were already closed by the time i got a chance to..what dept do i ask for?
When I called I just told the lady that answered the phone that I needed some information on opening a bakery. She connected me to the dept. I needed. If your county is like mine, you have to be persistant or they will give you the run around.
