Hi guys,

I want your imput on my situation. I purchashed a mattress at Macy's in June of 2003. A Simmons Beauty Rest which came with a 10yr warranty. So when I noticed that the mattress seam was coming appart in one of the corners, I immediately contacted the store. They scheduled an appointment to have an inspector come out. After not hearing from them, I called only to find out that they claim that there are stains or soils on the mattress which voids the warranty. First let me start by clarifying that there are NO STAINS on this mattress. I've always had a waterproof mattress cover on it. When I heard this I was in disbelief that a stain could void a warranty... what does a stain have to do with the structure of the mattess being compromised? in their warranty info which I've now read in detail. They never explain what constitutes a stain.. a water drop size stain could void a warranty. So basically they are saying ... buy our great product....which by the way is not cheap ... they forget to disclose that if you dare use the product they will void the warranty for any minimal stain whether or not the stain impacts the cause of the defect....

I'm sooooo mad that the industry takes advantage of consumers this way!! I've written an email to a local news channel problem solvers hoping to get the company exposed. I filed a complaint with the fcc and the state attorney. In my opinion both the manufacturer and retail store are both at fault ... the manufactorer for such a bogus warranty clause and the store for not disclosing details to the consumer.

after being told about their bogus "stain" claim. I went online to research if there were any others with the same problem.... I was shocked to see how many hundreds of people are experiencing the same exact thing I am. I was thinking of investing in creating a website titled something like SimmonsSucks.com.... so when people go to research a pottential purchase for this product ...they get to hear stories like mine... if I had purchased a mattress with the knowledge that there would be no warranty I don't think I would have spent as much as I did.

does anyone know what it takes to register a domain?? I'm willing to learn to create a website just for revenge.. I want people to be warned before buying this product.

You can register a domain for as little as $3-$4 per year.

HOWEVER, be aware, that SIMMONS will eventually find out about this, and will put pressure on you to close down, or maybe even sue you. It happened a few years ago to someone who used to work for Earthlink. They opened a site like this, it got popular, and after a while of losts of pressure from Earthlink, it was closed.

Free speech isn't always free speech.

There's nothing wrong with disclosing poor business prectices, just be careful how you do it. a small less than $10 investment can bring more headaches than it's worth.

Not trying to dis-courage you from doing it, just making some points to think about.

Some stores here insist that you purchase that spray stain protector for the mattress or the warranty isn't valid, don't know if that is the same where you are kiddo. I know the last two mattress sets my daughters bought had that stipulation, could be just the store policy, I don't know. I know that I went and sprayed them for them, it cost about $40-$60 for the kit. I totally agree though, has nothing to do with the stitching coming apart.

If I were you I would keep trying to get them to accept the warrenty. My Aunt also had a simular problem. She purchased a new mattress and boxspring it was a sealy though. after 6 months of owning it the mattress was sagging. she put in a claim for it under the warrany and they tryed to deny it saying that it was the frame she had it in that caused it. The funny thing is the bed is a handmade bed that is over 100 yrs old. the mattress and box spring actual sit on a wood base that is solid not like bedframes that we have now that its open underneath. she actually had to get a lawyer to write a letter then the honored it. she got a new mattress but they said she has no warrany on it. It cost her like $60 to get the laywer to write the letter still cheaper than buy a new mattress
