I know it's illegal to sell cakes in many states from an unlicensed kitchen, but I'd read something on here that it isn't against the law to accept donations; is this falsified information?

I think this is true, especially if you are honest about the fact that you are not licensed and cannot legally sell your cakes.

Donations are compensation, and the state/county isn't fooled by the distinction. If it's illegal to sell your cakes from home, that means you can't take any kind of compensation, including barter, including donations. Naturally you would want to call the health department in your county to clarify. Laws are different everywhere (God Bless America usaribbon.gif ) icon_biggrin.gif

My own health department rep told me that I didn't need a license to sell cakes to "people I know". It can't be friends-of-friends, just direct one-level knowledge. I am giving up my license next year and will be moving to only making cake for "people I know". icon_smile.gif

You are in California, I don't think there is a legal way round it. they do not want home baked goods for 'sale or trade', even if you are reimbursed for ingredients or accept a 'donation'.
