I'm curious, not interested in opening a business right now, but this has piqued my interest. It sounds like Kidscakelady will really need to have permission to reproduce because she makes cakes mostly for kids, and kids love those licensed characters! I personally would not want to have to put a toy or an edible image on all of my cakes, because the grocery store can do that. How does one go about getting permission to reproduce a licensed image/character, etc? I can imagine it's an exhorbitant fee, but if your livelihood depends on it it would be worth looking into.

WOW!! I haven't been on in a couple of days, didn't expect this thread to have so many responses. I understand everything that has been said here and I am trying to re-think how I will go about continuing to market to my fellow mom's for kids cakes. I want to be sure to do everything on the "up and up",certainly wouldn't want the "pan police" to come after me. icon_eek.gif

I have checked out a lot of the websites that you can purchase figures from and they have great selections. I think that the way for me to go is to do backgrounds that I create and then use the figures if someone asks for one. I am actually REALLY happy to hear that I can't do those dreaded stars!!! icon_biggrin.gif They are a killer on the hands!!

Thanks so much for all of the input here. Everyone has been so helpful with the start up of this new business venture of mine. The business should be up and official by the end of the month. BTW- thanks also to those who offered ideas for a name of the business. We (mom and I since it will be run out of her house) decided on Country Kitchen Creations- OUr craft store used to be called Country Crafts and we are planning to use that fact in our advertising as SOOOO many people keep telling us that we should re-open the craft shop.

So, someone clarify this point for me because I think I missed it.


If I buy a figure of any sort, or a toy car or whatever and use it as part of the design on a cake that I sell ...............would it be..... or not be an infringment?

I understand all the rest but not sure on the "other regular toys" out there.

You can buy anything you want and put it on your cake design. What you can NOT do is duplicate (FBCT, star tip, mold from fondant or gumpaste, chocolate transfer) in any way a licensed character.

Yes, many people do them anyway in ignorance or defiance of the copyright laws. But it is also legal to do it for no payment -- i.e. nobody paid me to do my son's Backyardigans cake and niece's Elmo cake. I did them for free and enjoyed it, but I don't advertise them on my web site.
