Dragees (Little Silver Balls) Illegal In Some States?

Anyone out there up on this? I was just looking to buy some gold dragees and saw they won't ship to Florida because they are illegal?

I know it is illegal to sell them in CA--some nut lawyer saw to that about 6 years ago by filing a class action lawsuit and then extorting so much money from shops and wholesalers that they had to give in and stop selling them. icon_mad.gif

I found the disclaimer on sugarcraft.com about not selling/shipping to
CALIFORNIA, TEXAS, COLORADO, NEW JERSEY, ARIZONA, or FLORIDA --and those additional states are news to me. I guess some other crackpot lawyers in those states figured out how to make a buck off of a non-issue, too icon_cool.gif

I'm not sure where the boundaries are on this. As I read it, it's illegal to sell them, but I see nothing about it being illegal to sell or make or eat things that have them on as decorations.

It's sort of like fireworks here in OH. It's illegal to use or own them, but we have places here that manufacture them and sell them. If the cops see an OH licensed car in the lot of a store, they'll ask to see ID for the occupants and then fine or arrest any OH resident who purchases fireworks--stupid, stupid, stupid.

I've found several stores here in CA that will sell them but list that they are not to be eaten and are for decorations only.

I've also bought them off ebay and the seller still mailed them to me.

Yes, they are illegal in Texas. Some internet stores won't ship to Texas.

NOt many people know that they are illegal; however, I tried to order them from 2 companies and that was what I was told. I was even sent an article that listed the states they are illegal.

While they aren't illegal in Nebraska, a major local craft store voluntarily pulled them off the shelves. No biggie for me....loved them as a kid, but way too hard for me now!

I have heard of this before but, didn't think New Jersey was one of the states. I am able to get them at a chain store as well as a cake supply shop. icon_confused.gif

They are illegal because they are made from non-edible materials (the metallic coating). I was told there was lead in the coating, as well. I'm thinking you'd have to gorge yourself on them to have it be a problem, but that's lawyers for you.

Miles Cakes in Miami ships and I live in FLorida. I called them the beginning of January and they said they were out of the silver but have plenty of gold dragees. They said shipping is around $4.00 since it's a small item. They were expecting the silvers in mid-January.

I'm in KY. They sell them in my WalMart!

I used them on The Cake from He-- and The Trilogy Wedding Cake I. However, I was VERRY careful to tell those helping me cut the cakes that they were to REMOVE these from children's plates and advise all adults to not eat them. I'm more afraid of the choking hazard than I am lead poisoning.

They sell them here in AZ, I saw some just the other day. I haven't seen them anywhere but gourmet type places though and they probably do say non-edible (just like some of the dusts). I guess they'd rather people put BB's on their cakes. icon_razz.gif

Speaking of which..... not to go too far off topic but I went to Taco Bell about a year and a half ago, I bought a MexiMelt. Loved those things. I came home started eating dinner and bit down onto something that broke my tooth in half. I removed this little thing from my mouth and had my husband check it out and it turns out it's an identical match to the BB's he has in his BB-Gun used to shoot the trees to scare the squirrels into leaving the house alone lol, anyway, we went back to Taco Bell I walked in asked for a Manager and she inspected it and said "Oh well ya know what that comes from?" and paused for a moment or two I got really short with her and said somethings lol she said "No hun it is from the bullets used to kill the cows someone evidently didn't clean the meat properly and left one of the pellets in there here is your refund for your dinner thank you for notifying us" and walked away. I contacted a lawyer the following day after leaving the dentist who charged me $250.~ to attempt to fix my tooth but in turn had to remove it because it couldn't be fixed. The lawyer told me they don't use that way to kill the cows anymore it's an electric probe blah blah blah and if I still had the BB pellet I could sue Taco Bell for it.... well needless to say she kept it and I couldn't even get my $250.~ back for the dental work.....

But yeah I won't use these Dragees just because they are so hard and I would be so scared of someone choking on one of them and sueing me lol.

I am able to buy the dragees here in Tucson at my local cake supply store. shhh.gif The owner must get them from a larger supplier, however, because she puts them in little dixie cups with lids. icon_confused.gif

I may be aging myself icon_lol.gif , but I remember when McCormick sold the dragees in the grocery stores.

I could buy them up here and the silver ones also. I had no clue that they were supposed to be toxic and illegal in some states, although I am in Canada. Like someone said earlier, it would probably take alot of them to harm you. Some lawyers will always find something to sue someone over. Thanks for the info though.

I also thought about luster dust. Here I could get 24K gold that is in powder form and silver also. Would they not be bad for you then also? Just a thought!

I live in Florida, and have bought silver dragees in a local cake shop, and we also have a grocer called Fresh Market that also carries them, I believe they are a bit larger, than the ones I bought at the cake shop.

Interesting that one cake shop said the reason why the dragees are hard to find is b/c you could "chip or break a tooth by eating them, not b/c they are toxic" and people are afraid of being sued.

Hello I 'm new here. But I have a great idea and solution to the dragree problem. Just released ...new FDA approved for food.... Platnum dusts. I just ordered every color they come in. You can get them online from country kitchens (www.countrykitchensa.com), they also have a catalog. You can make hand made pearls out of gray fondant then apply the Platnum dust brilliant silver, then just like that you have fda approved for food silver dragrees. FYI they also just released FDA approved for food Luster dusts. These can be found on pastrychef.com. I have not bought these yet, but I will!!One more thing you can purchase, FDA approved petal dusts from the country kitchen web siten by crystal colors. These are all great products and are all edible.

I think it is so stupid that some bored big shot lawyer with nothing to do decides that because they are bored they are going to think of something to outlaw. I used to eat these all the time when I was little. It was like candy and I turned out just fine. Sometimes I have to wonder about all the things they decide are bad for people.

This is soo funny. Living in Canada, especially in Nova Scotia, there are so many things we can't get here. I am always in awe of what you can by in the US.

Wow! Is that ever interesting. I never knew that they were illegal anywhere.
I am from Canada, (LaSalle ON)...And we have them everywhere, Grocery stores ,Bulk stores etc.
But very interesting to know that kind of info.
