I admire that the woman wants to do it legally or just get out all together. BUT it is ignorant and offensive of her to go to a KNOWN DIRECT COMPETITOR and ask to rent kitchen space from them. That is just loony tunes on business level. I don't understand why people don't realize that if you try to open/run a business in an area that only has X number of potential clients right next to someone, or in this case under the same roof as someone who is offering the identical product you split the potential income in half right off the bat! A pie has only so many slices in it, I want the whole pie! Not just a slice icon_smile.gif

The OP said she owns a restaurant, not a bakery. It is not outside reasonable assumption that she doesn't bake her own things (the OP). That's all she had to do was say so.

I've seen this mentioned before....I mean, about the first post thing being sort of a hoax. What is the point? Who does that?

About the topic - it could go either way really. Post sounds a bit "uppity". The lady asking for rental space may not have presented herself in the best light. (trailer, 6 kids, competition issue) Maybe she's just not THAT sharp. Who knows. It's like an interview. You don't plop down in the seat and say...oh yeah, I had a crying fit last night and ate a whole cake! Especially if your applying for a job that requires you to be cool under pressure. Might as well shoot yourself in the foot, then go run a marathon!

I personally leave it to God. I have my own business to tend to & I like to think most of the time, these things work themselves out.

I make homemade candy, and I know a couple businesses that use store bought candy to make candy boxes ect. And I have approached them asking if they would like to use my stuff in their products.


I this this is just a fake OP but...... Everyone starts somewhere, And not everyone knows the rules, so maybe if you got off your high horse, and HELPED her learn them, she would know.

Why do you think YOU are so special to write someone off just becasue they are doing the only thing they know how?? Stating that she lives in a trailer, to me, sounds so snotty.

I would liek to add that a "trailer" isnt always way you think. I myself am looking into them, and people still call premade homes trailers. And there are some that are ABSOLUTLY gorgeous.

You just sound like you are full of yourself.

i live in NC and it's more complicated than "just registering." we are inspected by the health dept, we have to have a business license just like every other business, we had to register with the state, form an LLC, get insurance, etc. i'm not complaining b/c i'm very blessed to live in a state that allows home bakeries, but i definitely have to have accountability. i'm simply pointing this out b/c i don't want other north carolinians reading your post, thinking that they only have to register. i have enough illegal home bakeries around me that i'm competing against as it is!!! icon_smile.gif

You also don't know how someone will react if you approach them directly and tell them they are operating outside the law, no matter how nicely you phrase it. Letting the health department handle this is both safer and more effective, as they can provide this person with the resources they need to get legal, and they will make sure she doesn't expose herself to unnecessary liability.

The health department typically doesn't fine people who operate unlicensed businesses out of their house unless they continue to do so after being warned or are flagrant violators. The real worry is the IRS, as they will charge fines and penalties for "innocent mistakes".

I didn't get that at all...the OP did not make any negative comments about this person's living situation, mentioning that she lived in a trailer was simply a statement of fact (although it is a bit odd that she would mention that to the OP).

Lest we forget - Paula Dean (multi-millionaire) started off by preparing box lunches in her kitchen. No health department, no inspections, nothing. She knew it was wrong but she did it anyway because she needed to support her sons and turned to the only thing she knew - her stove. Nobody died, nobody got sick. I do agree that we dont know how she will take it. Thats always a risk right? Just liek the mother my not have realized the OPs reaction in her request. BUT I think that when you know more about something then someone, who is just starting out, then whats the harm in letting them know the rules of the business..... even just saying, there are things you need to research first.

And it was not just the "mention" of the trailer. It was the "Lives in a trailer with 6 kids" line that hit a sore spot, TO ME, trying to make her sound like a dumb hick. Everyone has to start somewhere. Everyone has their own burdens to carry.

And trust me, I have no biases against trailers since as I mentioned, I am looking at purchasing a mobile home myself.

May I ask you, how many children do you have? Now how many do you have to put into child care? How much food do you have to buy them. Clothes. Medicine.

Im sorry but sometime you have to do what you have to do. If you have a job or an arrangement that entails you to enough money for everything, kudos to you. If you dont..... sometimes you have to choose the path that you may not want to walk down.

I could use the cash like no other and have worked to hone my skills, but you know what? I live in a state that it is illegal for home baking. Period! So I dont get to bake as a business (or for the extra cash I could desperately use). I dont have a problem for legitimate business to get upset over illegal baking. Especially in states like mine, where it is a virtual minefield of work and money to get there!

I agree that sometimes life is difficult and people may need to make hard choices to make ends meet. And sometimes people need a wake-up call when they are doing something that exposes them to potential financial ruin.

If this person's situation is so dire (and it may not be, not everyone who lives in a trailer is struggling financially icon_wink.gif), a polite message from a competitor will probably be ignored. A visit from the health department will not, and that visit will result in this person getting the resources she needs to get legal, or she will come to the realization that perhaps there are better ways to make money than running an unlicensed food service business.

The health department is not a swat team that breaks down the doors of unlicensed home bakers, nor do they hand out punitive punishments (except in the most egregious cases). If you really wanted to screw over an unlicensed business, you would report them to the IRS.

I'm sorry if you think I'm just making up something or 'stirring up drama' I have actually been on CC for quite a while but have just moved and lost my login info. She never said she wanted to use my kitchen to become legal, just so she had more oven space. She asked me if I would buy her bread and cinnamon rolls from her rather than the legal bakery down the street or if I wouldn't be willing to do that possibly could we 'work out something' so she could use my kitchen. She told me she is currently baking out of her trailer, I don't care that she lives in a trailer thats just where she told me she is baking. She also knew that I bake my own cakes, pies and pastries because she commented on my sign when she walked in. Didn't realize this was such a hot button post but I just wanted some other opinions before I jumped the gun
