Gray Areas

This may be a silly question, but does anyone know at what point legal becomes illegal in New York? (Buffalo area) I understand about the home kitchens, but I'm wondering about gray areas.

I'm a hobbyist and I don't particularly want a home business (yet), but if a friend asks me to make a baby shower cake, do I have to do it for free or turn them down? Every time I've touched on the legality issue with someone, they just look baffled and say "but I want you to do the cake!" I don't advertise and have no plans to do so. Even my DH looked at me like I was nuts when I brought it up.

I can and will call the local Dept. of Ag., but I was hoping it wasn't necessary.

Sorry if this is obvious or silly icon_redface.gif but I was wondering. Thanks!

if you are just doing this here and there for people you know, then i wouldn't worry about it.

Its when the friends of friends friends start calling you that you might want to think about getting legal. So in other words as long as you are doing cakes for people you personally know don't worry about it.

i wouldn't worry about it if you are just doing if for friends and family. Even if it is for money. If you just want to make sure the department of ag won't b upset, contact Wayne Wheatley. If your kitchen is in good condition he comes in, looks around and explains some procedures to you. Not a big deal really. Then you have your 20-c exemption and its free and he doesn't come back unless there is a complaint. Income tax as a hobbyist and all of that is a whole other ballpark...
