My DIL is making a BD cake for a friend's little boy.
His party is at Chuck E Cheez and he wanted Chuck E on his cake.
I told her I didn't think it would be the thing to do. Trademark and all. They probably wouldn't allow it in the door.
(although they DO allow you to bring own cake. I had my 54th BD party there icon_lol.gif )
Anyway....it got me to thinking.
When is it legal to make a trademark cake? Is it ever?
Some day she wants her own cake business and wants to know. Thanks!

does it have to be an exact replica of Chuck E? If it RESEMBLES Chuck but is different I don't see a problem with. However, I wouldn't do an EXACT version of the rat due to licensing.

Well I dont know...but if you arent SELLING it can you still replicate characters? Maybe you could just call that chuck E Cheese store and ask a manager or something if it would be allowed for such a thing and if they say "yes" get their name in case there are problems down the road.

NO. You would have to order that from them. I would suggest just using the colors, but stay away from the character or logo - ESPECIALLY on the premises!

I bet she would be fine to take it. The employees probably have no idea that it's a trademarked chaacter, even thoiugh they work there. If she's making it for her own child, it doesn't matter. They would probably get a kick out of it. She could always call and ask.

If you need it I have a picture of the SIDE view of Chuck E from the one time I've visited there lol. It has my munchkins in it so I won't post it but if you need it for her to by as a template I can edit it and send it to ya lol. But I wouldn't advise doing an exact of him. Maybe something similar he is a mouse so maybe just a large cartoonish mouse icon_wink.gif

Can she buy a Chuck E toy from the place to put on the cake? If so, she could decorate the background scene and put the toy on the cake on site. That would violate no rules, and her child would have his cake.

my little girl is having her birthday there tomorrow icon_smile.gif i think i am as excited as she is. it did say you could be your own cake, and there was never any mention about it couldnt be chuck e cheese himself on the website....i thought about doing him, but talked her into something different. i am sure there will be no problem or they would of made that point clear int the section on the website about bringing your own cake... could be wrong though...

I don't think they would get into copywrite laws when talking about bring a cake. I think they would assume that decorators would know the laws and pay the royalties accordingly.

well, i guess the best thing would be to call. and i am curious to know what they would say. as far as the copyright law...alot of people who make their childrens cakes do not know about that. and it seems if there was a website that gave the option to bring in your own cake into their business- then they would state that you could not use the logo or trademark, since it is a law that alot of people are probly not aware of.
