What's My Liability?

I only make cakes as a hobby. I don't have any intention of starting a business. I hear the stories on these forums and realize that it's hard, hard work. I love to do it, but don't need the pressure.

I baked some cakes for a local charity and, as a result, got a phone call from a woman who would like me to make her some cakes for a baby shower. I'm sure she's planning on paying me for my work.

I would love to make the cakes for her, but am afraid of my liability in this situation.

Any advice would be GREATLY appreciated.

First I would check with your local health department and see if it is ok. Many of us do this from our homes and it is ok some states really crack down on home baking. Where I am at I was told as long as I don't advertise as a bakery it is fine. I go by word of mouth and doing friends of friends.

Check out your state regulations! You don't want to get into trouble. Where I live it is fine as long as you are baking non-potentially hazardous food items. It just depends on where you live. Maybe you can do it, and find you may pick up more business (and with confidence). icon_wink.gif

Phone the health inspector, they will tell you. In my area I can't advertise or use perishable foods (like custard), but can sell cakes to friends and word of mouth.

If it were me, I would do the cake.
