Artistic Cake Contract- Not Wedding Cakes

Does anyone out there use a contract NOT specific to wedding cakes?

I have been very busy lately with my new cake business and I need to cover my shiny-heiny in case something should happen.

I don't do many wedding cakes yet, but I seem to specialize in the more outlandish, creative, cake sculpting found in ACE of CAKES and the like. I enjoy it immensely. My guarantee is that I will never do the same cake TWICE.

If anyone has a contract that they would like to share, I would be very appreciative.

I would specifically like to address the "artistic" aspect of my craft. For instance, since each cake is a unique piece of art made especially for that particular client it means I have never done it before. They don't have a picture to choose from in a catalog....just a mutually agreed upon design that may or may NOT be the same! I have never had an issue, but I just want to be covered in case I hear, "that is not what I pictured".

Any ideas?

I don't actually have this in my contract, but I do tell my clients when they have brought me a photo...that their cake will be "my" rendition of said work and there will be small variances and I make sure they understand that my cake will NOT be a carbon copy of another artists work.
I also find it helpful (as I have an art background) to do simple sketches when consulting with clients....(especially designing an original that doesnt have a photo for reference) and make sure that we are on the same page. Just rough little drawings...and they can point things out and say .."yes, like that"! ...or .."no...more rounded edges" etc...as I find we cakers have a language all our own...many have no clue when we bombard them with round edged...tiers.... layers...etc. Many noncakers think tiers are a "layer" and get lost when you try giving them too much info...I find my drawings to link their wants and my design perfectly.

Maybe a line in the contract to the effect that..."the finished product will be to the best of your artistic ability, a rendition of a design agreed upon between said party and yourself"...?

I like that....and I anticipate something to that level.
My brother is an attorney and I asked him about "creative license" and "artistic" interpretation"...haven't heard back, but if people are interested, I will post what he says.
He, of course, will help me with the final contract. Good to have a lawyer in the family. icon_biggrin.gif
