I work a fulltime (and then some) Job and recently they have heard im making cakes, ive made a few for birthdays here free of charge more to get the practice.... Now we on the 1st work day of each month have a morning tea. Many people have suggested that i make the birthday cake they normally have here which im happy to do....
My problem is this....
In order for me to do so they HAVE to legally pay me as its a service. However under my contract i can not legally work for anyone else.
They know im thinking about starting a cake business (well i am but im keeping it quiet).
How do i get around this? In order for me to do it i have to send an invoice. But im not a business yet,. and when i am work will have to know about it.
Im going to talk to my boss in the next few days (or week cos were so busy at work) about it all but i wanna know how people would raise the subject.
(My boss knows ive been financially screwed for the last few years due to a housefire and accident i had in trying to escape, then having to recover the costs of it all, even tho i had insurance it didnt cover much).
Any help would be awesome!!!!!

I think you should talk to your boss. Most likely your boss will be ok with it as you can explain it's a once a month deal. Also, explain that the money will help cover the cost of the cake. Anything extra they don't need to know about.
Now if this is just for friends that get together I wouldn't even bother to talk to your boss about it. If your boss should find out you could say the money was to cover the cost of the cake and electric fees.
I wouldn't tell them it was a business you have on the side.
I am in exactly the same position as you. I work full time and have this as a side business. Not sure how it works where you are but we have to have a tax file number but do not have to charge GST so I just put "No GST" on my invoices.
I just approached my boss and said that I'd make my cakes for work and I'd charge a little less than what we were paying to the company we were getting our cakes from. He was happy with the cost reduction and went with it even though he goes on and on about "segregation of duties". I just ignore him and keep bringing the cakes in and get paid out of petty cash.

Okay so it's something you love doing but to me you shouldn't have to pay for all the ingredients, time etc. You are doing this out of work hours so I don't see why your boss should become involved.
We all know how much it costs and what is involved and it is something that you can't put down on paper every little thing.
Charge them the upfront price,with your time included, nothing is free these days. You can always inform them that you are not making a profit and good on you if you manage to purchase supplies at discount prices.If you are questioned tell them you are doing it as a hobby and for the practise and hopefully when you have had plenty of experience you can branch out on your own. This is how I started out many years ago but I'm afraid it is not a hobby anymore. I do enjoy it but when it ceases to be fun then that is when I will give it up. Good Luck.

1) its work that holds the morning tea, the company pays for it.
2) Under my contract it says something along the lines of the company i work for is the only company and should i wish to work for some other company at the same time i have to get approval from the New Zealand manager person
i think they will be ok with it im just not too sure about how to go about talking to my boss....

boss -- you (they, this company/division) wants me to make the cakes -- so, how do we handle this little requirement?

of course, they could make it part of your "official" duties for the company at a PAY Raise of course, or bonus checks
Lol not married and no other half... recently single....
As for the pay rise thing i had to laugh hard at that... I LOVE the company i work for and the people are great most of the time. But the money aint great and the work load has doubled. the other girl i work with got a lil stressed out and had to take 3 days off work as stress leave, leaving me to do her job as well as mine... this week i have so far worked an extra 8 hours and im due to leave now (at 9am) on my weekend to go into work for a few hours.... By the end of the weekend i would have prob done 20+ extra hours and i wont get paid for it. I gte it as time in lieu.... but theres no time to take it... the work builds up again.... Really giving me a headache and im just lucky ive got no cakes to do this weekend....
Im going to talk to my boss on monday when im almost in tears over having to spend my whole weekend at work!
Ive been pushing for a payrise since about Feb this year... over and over... and nothing
Well... Update on this!
My Big Boss has said that its ok for me to do the cakes each month... All i need to do is give them a reciept for some ingredients up to a maximum of $30 which is ok no problem. However.... I have to make the choice each month on what to do! Eg, what flavour, what shape etc.... Normally the cakes are to feed 40ish people. Which to me doing them for my work is more about experience and extending my skills....
The first one is due Monday 2nd July.....
U have NO idea what to do!!!! lol
People keep saying my cakes are awesome and they are really looking foward to seeing what i come up with this month... I dont want to offend anyone tho!
I have spoken with the lady incharge of the morning teas and we have recided that this month it will be a banana cake but i have to do the shape and decorations myself with NO input from anyone else so its not like im favouring anyone...
Gosh i hope this makes sence lol. I was up most of the night doing business stuff and everyone at work is trying not to fall asleep... i think its been one of those days.

I love making cakes for work because I get to do what I want most of the time. Best experience you could ever ask for. We are so lucky because we actually get PAID to practice!!!
