Responsibility After Setup

I was looking for a cake contract and found some on this site but there is nothing in any of them that says anything about us being responsible for anything that happens to the cake after it has been setup.

I setup a cake last night for a wedding and when I left it looked great but I got a call about 8 last night (7:00 wedding) at the shop saying the bottom layer had cracked. When I got there to setup the cake it was hot and I had previously told them to make sure the air was on and it was cool in there by the time I delivered. The wedding was in a old warehouse that had been converted to a reception hall so you can imagine how how it was. Sorry I am rambling. Anyway the icing wasnt melting when I left but the chocolate on the strawberries was getting tacky on the grooms cake.

Should I be responsible if something happened to the cake after i left? I dont know if someone bumped te table or moved the cake stand or if tehy left the air on or turned it off. I just need to know how to answer these people.

This is the clause I have in my contract:

"We are not responsible for any damage to the cake after setup is complete. The client is responsible for providing an appropriate and secure table and environment for the cake(s)."

My contract is on my web site at www.cakeboss.com/contract.aspx and anyone is free to modify it to suit their needs.

Once you take a picture and leave, in my opinion your responsibility has ended. A lot of decorators require someone to be present and "sign off" on the cake, which is a good idea.

The terms another decorator works under don't necessarily apply to you (or me) just because we decorate cakes, too. What's important is what your client and you agreed to. What did YOUR contract say?

Thats the thing, I dont really have one.

I talked to the mom on the phone yesterday and she was ok. I explained how hot it was in the building when I got there to set up and she apologized and said now she understands what happened. She is ok and I feel better but i would like something for future clients so it is understood before.
