There is an up to date list of states that allow legal home baking here:

If your state is not listed, then it is probably not legal to have a home cake business. As always, call your local health authority for the exact rules in your municipality.

This thread is too large and unwieldy for me to continue posting updates. The link above is the best and most current source of information.

Does NJ allow home based bakery. Is there Cottage food law in NJ? I know they have been working on this.

According to the list they are still considering NJ Cottage Food laws.

Colorado's cottage food law just passed committee. House voting Tuesday, Senate voting Friday, and if it passes both Colorado will join the list of states that allow it.

sorry, but WI does not have a cottage food law. this is in the works but not quite yet.

you can only have a separate kitchen from your home with all the necessary equipment from a regular commercial kitchen.

California has one in the works -- AB1616. Not finalized yet and I don't know how close it is. You can look it up on the internet and see how it's doing.

I haven't seen anyone post in here yet but Colorado is now on the list of states with a Cottage Food Law!! YAY!!! Not sure I agree with the $5000 cap but I suppose if I were to make that much in a year on cakes, then I will need a bigger kitchen anyway! It passed and that is all I need! Time to get the ball rolling... or cake baking! icon_biggrin.gif

yes they are! I'm so excited that WI is in the works! for some odd reason we are also looking at a cap but it is $10k. dunno why! just something for them to regulate on again :p
