Does anyone have any information specific to the County of Santa Clara as far as regulations or who to contact? Any information you can send my way would be appreciated.

As far as I've heard, it is not permitted in California. However, you should contact the Santa Clara Health department to confirm.

HI, I live in Hollister and few other people from CA have look into this and you can not sell cakes from you home at all. You have a commerical building and meet all the regulations reguied by the health dept. So, people a few cakes once in awhile and try not to get catched. The State does not allow food made in home to be sold. Iitscake who is from San Jose, also looked into this and a lot of things are required. Drain in the floor, separate sink for washing hands, etc. You call the local health department. If you get caught I am not sure what the fine would be, I am not willing to take the chance.

Thanks for your note. Itsacake lives about 4 houses down the street from me, small world! I have been giving away cakes like crazy so what I am wondering is can I ask that they just reimburse me for my expenses? Or do you think there would be a fine associated with that as well?

Whatever you do Samsgranny, cash is best. Checks and other transactions are written agreements. Cash could simply be for a million things other than cake decorating/orders.

Even if they reimburse your expenses, it would be considered a sale. Many choose to take the risk, but you are not protected from liability or fines.

I called the Health Dept in Kern County and they said that if I didn't make a profit then they would not get involved. So I guess here it would be okay to get reimbursed.
