Hi have just read an article with regard to copyright laws. I never even give it a thought as there are so many bakers out there that use such charactors and logos.
I have made two cakes using such things one for my neice and one for a friend would that count as infringement of the law as i didnt get padi for them and can i upload photos of them to my site and facebook but state they are not for sale. icon_sad.gif

Payment has nothing to do with copyright/trademark infringement. The only bearing it has is how much the court will award in damages.

People who do this all the time should know that over ten times in reproduction changes the charge from civil to a federal criminal charge. They would not have wriitn the law this way if they did not intend to go after small vendors.

Your idea of putting it on facebook is exactly how they are finding violators. This is becoming a lucrative business for attorneys, as the infringer posts and claims the violation.
