I'm not really familiar with how the legislature works but I'm guessing the govenor knows nothing about this bill yet. It can't hurt to send her an email supporting the bill though...go for it!!

So as of today the bill has officially been passed to the Governor and is awaiting her signature!!!

i read an earlier draft of all the rules does anybody know how this is going to work?
do we have to have a seperate kitchen? an inspected kitchen? a business licsense? im so happy so many times people have said i'll spread the word for you and i qiick had to stop them it would be so nice not to hide.

You would not be able to get a business license working in your residential kitchen under this new ammendment, as a license requires you to prepare all food at a government-approved kitchen. Here is a link to the exact wording:

This basically says that you will no longer get in trouble if you sell your baked goods out of your residential kitchen as long as you disclose it to your clients.

my husbands co workers love ordering stuff from me cakes, pastrys, pies etc. I can now not worry about somebody ratting me out? its ok for me to recieve money now?

There is a pastry cook at my husbands work that has become very jealous for the fact his orders dropped terribly once everybody saw i could make them new kinds of cakes not his traditional grocery store cake, and until now i have been so scared he will just cut my cord and call somebody on me. Does this mean i actually have a chance?

Yes, Pebblez this is exactly what this new law is. Anyone can make/bake confectionary goods from home and sell them without a business or license. The only things required are a food handler's card, ingredient label on each product and disclosure that the product is made in a home kitchen.

Update on the AZ Cottage Food Law -

The governor signed the AZ Cottage Food Law and it is official. The law is tentatively scheduled to go into effect on July 20, 2011 and all rules and regulations should be posted on http://azleg.gov/ (bookmark & watch for updates). I just spoke to a state rep. This is wonderful news, so bakers...start your engines!!!

Just popping in because my state is working on a cottage law, too, but I saw someone earlier in the thread ask about a business license...

Regardless of the HD laws, you still have to have a business license to run a business and report your income on your taxes.

This is different though. Since it's a Cottage Food law, nobody has to have an acutal business license. It's no different than doing a bake sale, baking for a work, church or charity event. You can sell the products and no license or health inspection is required according to this new law.

Wait....how is this different from someone selling homemade jewelry or any other small business product? Anytime you sell something for profit you need a business license... the cottage laws are just removing the health department license requirement for non-perishable foods. It's making baked goods be just like any other home made product for sale. I suppose many people don't get a business license and don't report taxes, but you are supposed to be doing it. A bake sale is non-profit, that's a different story.
