I've been asked to make another cake decorator's design. The customer sent me a pic of the cake, which has the competitor's website on the picture. This is a very popular because I've been asked to make it twice. Once I made it exactly, and the other time, the colors and some of the designs were the same but I added alot of my own "extras". This time I feel funny making it. What would you guys do? The competitor is in the same state as me so should I tell the customer to contact them instead? Is it illegal for me to copy someone's else's design? Pls give me your thoughts. Thanks a bunch! icon_biggrin.gif

Brides bring me photos all the time saying "this is the cake I want". That's the purpose of having cake photos out there.

I always tell them "Guaranteed NOT to look exactly like the photo!"

Berl,

IT HAS TO BE HARD BECAUSE YOU LIKE DOING CAKES BUT I DON'T THINK IS COPYRIGHT SINCE IS THE CUSTOMER THAT CAME TO YOU.

1. HAVE YOU ASK YOUR SELF IF THE CUSTOMER LIKE'S THE WAY THE OTHER CAKE DECORATOR CAKES TASTE?

,MAYBE SHE LIKES THERE DESIGN BUT NOT THE TASTE. ALOT OF PEOPLE CAN CREATIVE A BEAUTIFUL CAKE BUT IF THE TASTE IS NOT THERE WELL I WILL BE SEEN SOMEONE ELSE.

IF YOU STILL FEEL UNCOMTABLE THEN TELL HER BUT I THINK YOU SHOULD KEEP THIS CUSTOMER SHE IS THE ONE THAT SEND YOU THE PIC NOT THE OTHER WAY AROUND/

I believe there is no conflict as long as the photo does not have a copyright on it.

I get requests all the time from brides who bring in pictures and want certain design elements. I tell them it may not come out exact since it is not my design originally, but I will do my best to replicate it. I do it all the time. Unless it is a licensed character or something, no one can come after you. I would not feel guilty at all about recreating it if i were you.

I wouldnt feel guilty either, you can change a little bit of the design if that makes you feel better

Thanks guys. That's kinda what I thought but I wanted to make sure. And also, I get most of my designs from CC cause all of you are SO creative! icon_wink.gif

I say go for it .....you CAN'T copyright a design......you can't use the other person's photo but you can definitely make your own rendition of their cake!!

If you copied a cake out of martha stewart's wedding book would you feel weird, or out of the knot, or even wal-mart for that matter. as long as you are not trying to pass someone else's picture off as your own work, you should be fine. She has probably had someone come to her with a picture of your work and been asked to recreate it.

When I get my haircut, I take a picture of what i want with me icon_wink.gificon_wink.gificon_wink.gif

My great cake instructor once told me the first time you make a design is great. The second time, is perfection. Third time; boring.

Good for you that you can give brides what they want. So much for brides being original icon_wink.gif

I wouldn't worry about it a bit.
