That is the one I read, then.
Can anyone make sense of this? I get confused here:
"(2) A cottage food operation licensed by the department under
18 section 3 of this act is not subject to:
19 (a) Facility permitting by local health jurisdictions under the
20 Washington state food service code; or
21 (b) Inspections by a local health jurisdiction:
22 (i) An initial preinspection or renewal inspection as required
23 under section 3 of this act; and
24 (ii) Inspections in response to a foodborne outbreak or other
25 public health emergency."
NOT subject to preinspection.
Ok. The later, it says you must have:
"(b) A signed letter on appropriate letterhead, dated during the
28 current year, from the health department of the county in which the
29 cottage food operation is to be located as to the fulfillment of the
30 provisions of the Washington state food service code applicable to
31 cottage food operations as provided in section 2 of this act and
32 consistent with the applicable definitions provided in section 1 of
33 this act. The local health department generating the letter may charge
34 a reasonable fee for any necessary inspections and the generation of
35 the letter. It is the sole authority of the inspecting local health
36 department to resolve, for any given inspection, any ambiguity as to
37 the inspection authority of the local health department."
Huh? So, they have to inspect in order to find you in fulfillment of the provisions that are applicable to the cottage law...and they can decide to charge you an undetermined fee to do so....and what the heck is the ambiguity of the inspection authority mean?

Last part says: Typically a rule development of this type requires twelve months to complete. Assuming the bill is passed during this regular
session and becomes effective 90 days later, rules necessary to implement the cottage food licensing program will not be in
place to meet the effective date. Therefore licensing activities will not begin until FY 2013.
(Had to look up fiscal year, this means it would start October 2012).
Thought this might be important to some who are trying to plan for their business.
Ugh that's a long time .. Its ok though I have gotten in good with a catering company to use their kitchen and a restaurant that wants to sell my cakes and cupcakes as their deserts is going to let me use their kitchen but most likely just during off hours ... Wont let it get me down still want this bad ! Hope everyone stays positive and keeps enjoying what they do !
Please keep in mind everyone that this bill is still in deliberation, the wording can change at any time....The bill is currently in another House committee where they are considering placing it back to the State Agricultrual Dept vs Health Dept. They will take action tomorrow morning around 10am, I will notify you all when I get the latest updates.
Yeah that is what one of the senators told me i emailed one and actaully got responses by two lol both seemed very for it and said that alot of people were but we all know how that can change ...
I see the bill has gone back to the Ag Dept. and they are attaching more fees. What is the next step for this bill?
The Health Dept would have cost us more fees vs the Ag Dept, so the move is to our benefit. The Ag Dept already has the outline and infrastrcture in place to start inspecting where the HD would have to start up an entire new division that could have taken a while to implement.
The ammendments will be posted today along with where it goes now, which is Rules.
It is CRITICAL that we get as many supporters of the House on board as there are some who oppose this bill. Please start or continue calling each and every House Rep who is on Rules Committee...

Okay everyone, this is it....The bill has been placed in the Rules Committee....Now is make or break it time. This is where the bill could likely die in the current session....I URGE each and everyone of you to call the House Reps sitting on the Rules Committee, we must get this passed onto the House floor for a vote. We do not have much time!

It is now onto the second reading...It will likely be read within the next 2-3 days. Cross your fingers everyone!
Technically there are 3. It goes to Rules for the first, here they can decided to place it on the senate/house floor for the 2nd reading. Then on 2nd reading it is open to ammendments. The 3rd reading is final passage (they vote on it).
Our bill is awaiting the 2nd hearing, there are 2 potential ammendments for the bill (one being the gross sales limit will be lifted). Once the ammendments are voted on it will go to the 3rd reading and final pasage. This will take place at the same time. It appears the House is moving quickly through the bills, we should see results by Friday!

I just watched live, the House passed SB5748 with 2 ammendments. The bill states that upon inspection the Ag Dept can only inspect the kitchen, they have no authority to inspect your entire home. The 2nd ammendment is they increased the gross sales back to $15,000 and require increase overtime due to inflation.

It has to go back to the Senate floor for an offical "yes" on the House ammendments. Then it goes before the Govenor. Once she signs it into law it will become effective in 90 days (end of July).
This is so great. So do we know when it will go before the Senate?? What will happen if the gov shuts down in the middle of this?
The Gov just came to a deal, so no shut down
This will go to the Senate floor for Consent, this means they have to Concur on the ammendments from the House. We will likely see this Mon/Tue.
The bill is now on the Concurence Calendar which means the Senate will review it shortly. It should take place this week.
We are still in the same spot...I talked with Senator Rockefellers office today, they reassured me that the bill will pass the Senate floor and move on to the Governor. I am a bit concerned beacuse the session is almost closed, hopefully Wed or Thur it will finally move on. I will update the minute I hear anything!

No word yet on when she will sign it, I will definatley be going to the ceremony.
The law does not go into efect for 90 days once the bill is signed.
