Christeenna- that is exactly the point I made when I e-mailed our senator. Elkhart county is in deep trouble fiancially. Pointing out to our senators that being able to legally sell home made items can help some families around here survive. Any Hoosiers reading this needs to contact their state senator and make sure this bill moves quickly to a positive vote.

well, I will be watching this bill very closely. I don't do much but it would be nice to make a cake for a friend or co-worker and not feel that I am breaking a law. My husband and I just bought a house yesterday. Woo hoo. and he was even looking at spaces in a house that he could put in a small kitchen for me in the basement and he said he would make it my "cake room". I love my husband to be so thoughtful. I hope this would not infringe in the bill to have a separate mini kitchen to make cakes. I think my husband just really wants all my "cakey" stuff out of his kitchen. Narie, I did not know you lived so close to me. We should get together on day and have cake and coffee.

Note the one section that says the kitchen must be within the house.

Sec. 10. The home of a home based processor may not contain more than:
(1) two (2) ranges, ovens, or double ovens; and
(2) three (3) refrigerators used for cold storage.
The equipment under this section must be designed for home use and not for commercial use, and must be operated in the kitchen within the residence.


Will this be interpreted as it must be the "family kitchen"? No converted garage? A basement kitchen .... is that going be considered the "residence" kitchen or will they look at that as an add'l kitchen?

The language seems to want to keep it low key and simple.

I have no answers ..... just questions on this aspect.

Being totally clueless about the whole legislative process I had to read up. The bill passed in the House and went to the Senate.

Now if I read everything right it looks like the Senate made amendments to the bill that the originating house did not accept. So it went to the Conference Committee. They will write up a compromise bill and then the house and senate will have to agree. If they do then the bill will go to the Governor to sign into law. He could possibly veto also, but the Senate and House have the power to override the veto by majority vote.

So there are eight main steps for a bill to become law in Indiana and we are at step seven!!

April 15th is the deadline to get the bill passed.

Thanks for all the decoding ! When I saw all the numbers and codes and lawyer language on the gov web page,...my eyes just glazed over,.. LOL,...(that same look as when I opened a history book years ago in high school)!
Wish we knew what changes they are thinking about.

hmmm, i just got licensed in january after adding a second kitchen and jumping thru many hoops and going thru a lot of $$$$$. i wonder how this affects me in southern indiana

If you're already licensed, I can't imagine it would have an impact on you. If your local HD changes rules, try to find out if they'll grandfather you in, since you did do what needed to be done according to their rules at the time.

It looks like it's scheduled for review in committe on April 8th. After the senate made their changes, it was assigned back to Health and Provider Svcs committee.

Yes, if you go to the 2nd link posted in the original post (this one: http://www.in.gov/apps/lsa/session/billwatch/billinfo?year=2009&session=1&request=getBill&docno=1309&doctype=HB ), then under Senate Committee Reports you can see the changes.

Basically, it adds language to allow religious orgz's to have a church pitch in where people pay money for the meal, when the meal is used as a fundraiser for the org, or "....the individuals separately or jointly provide or prepare, free of charge, and consume their own food or that of others attending the gathering; and
(B) the gathering is for a purpose of the organization.
Gatherings for the purpose of the organization include funerals, wedding receptions, christenings, bar or bat mitzvahs, baptisms, communions, and other events or celebrations sponsored by the
organization."

This is just so great news!! I can't believe it.

Well, I have been away from CC for quite a while. I was very ill, in the hosptial and had surgery. Anyway, I was sent a private message about this bill. I love making cakes and did try to figure out ways to do cakes legally without opening up my own shop but quickly got discouraged because the options were limited. I just kind of gave up on making cakes. Now I have something to look forward to! This is very exciting! Thanks for the post Indydebi!!

go on your state's web site, there should be links for legislative bills etc and you can see what is going on. In NJ, you can even watch the votes live on your computer. Good luck and hope it passes for you
