I made a wedding cake for a bride, she brought me a picture and asked me to create the cake for her I didn't want to do it the same so we made some changes, it resembled the picture but was still different other then the shape. The picture was one of my competitors and she was upset when she say it on my site. What I'm asking is should I be removing this picture off my site. Any advice would be appreciated. Is there anything out there that says I can't have it posted or is is just unprofessional of me to not take it off.

Heck no don't take it down. You modified it, and we all copy and or take ideas from the Wilton yearbook.

i agree with that, it is your cake, but inspired by so and so...just give them a bit of credit next to your photo.
I agree with Doug. Don't take it down! If you had used her original picture, then yes, but if you made the cake yourself then leave it! Its your work. Even if you hadn't changed anything on it, you still made it yourself and its your photo.
Saying inspired by... is also a good idea. Or if you just name the pictures, maybe you could name it after your competitor?
I can copy a cake from a magazine, from someone who docent live in my city, but when it comes to a competitor, I just don't do it. I you choose to do it, at least don't put it in your web site, as if you are appropriating her cake and intend to do it again.

I don't think there's anything wrong with it or furthermore unprofessional. It's a cake you made similar to a design that a competitor of yours made. Ask yourself why the bride didn't choose the original creator to make the cake. You are the one who created it and it shows off your abilities, regardless of who came up with the idea. JMHO.

good point. perhaps in the future, you could ask permission first to duplicate the original design with a few personal changes as long as you note credit to that person when you post your photos ....?.....
You did not "copy" the cake, nor did you post her picture on your site. The cake is yours. Post it proudly.

She's mad 'cause yours is better!! I wouldn't worry about it. I wouldn't mind if people copy me. I know they do it. I would just be angry if someone stole a preliminary sketch or used my actual photo. We ALL build on the things that we have learned from others, seen in magazines, TV, internet, etc. I don't call that stealing.
I'd do a little credit or remove it entirely. I agree with Paolacaracas' comments.
They are really similar, down to the type of beaded ribbon used...and you knew where it was from before you took the order, otherwise you might not have decided to "alter" it any, right?

Thats my thought we are not on good terms already not my view but nothing I can do about it.
THANKS to everyone here on CC and your help I will keep it off my site for now and let things calm down she is my competitor and I don't need any bashing done. We are both in the same town and need to somehow work together.
Nearly every cake is a rendition of someone elses. We buy flowers made commercially, ribbon, pearls and all sorts of other products to make the cake similar to the one we want to emulate. This does not make the cake the manufacturer's or the other baker's cake. Cakes are not exact copies, even if you can say, gee that looks like mine, and it might, it still belongs to the person that made that particular cake. You never hear Collette Peters, Scott Clark Woolley, or any other well-known cake artist saying, you copied my cake. The only way some one can say "it's my cake", is to copyright the design.

This cake is decorated differently from hers. The shoe is different, you have a blue band around yours, hers don't. Plus hers got silver scrolls, whereas yours is plain. you may have used the hex and square like hers , but still it is a difference.

To be honest, does she really think she is the only one who has put a shoe on top of a cake? It isnt like she invented the idea. Though the cakes look similar, I dont think it is necessary to remove it from your site unless You feel that it will create negativity between you two that isnt worth it.

What the heck is she worried about!If someone posted my web site then I'd consider that a compliment!!A lot of people look at all of the comments that are made and will definitely go to check out her site.That means more business directed her way.Everyone has at one time or another taken an idea from someone else and changed it just enough so as to not copy it directly.Even if it's from one of your competitors,it's called business competition,we all do it in one form or another.If the customer has requested you to do this cake are you supposed to say "No, I can't do that cake because my competitor did it first, so maybe you should get her to do it."Not very business smart I'd say. Go ahead and post that picture!!!! You made it and it's totally different than hers.
