I am in the process of getting legal, but I would like to go ahead and get a website up and running. As of now, we are selling to family, friends, and co-workers. Some have asked if we have a website. Is this possible to do until my kitchen is legal (hopefully this summer)?. I just want to have an about me page, upcoming events, and a gallery of my work. Will the HD be after me, if I do this? Would love to see how others have set up their website without pricing or mention of actually selling.

If you are not selling, and make no mention of selling, there is no reason you can't have a website displaying your work. It's really no different than displaying any other photos or hobby work online.

I'm not currently selling any cakes, but I keep my web site up just as a personal showpiece.
