I've had my website for four years now and only been legal since January. *shrugs* icon_smile.gif Of course its not illegal to work from home here, just need permission...not sure what state the OP is from.

If her cupcakes are dumb looking then I wouldn't even be upset anyway. Your word of mouth will get you more business than her ugly flyers.

There are people who advertise on CL in my area doing cakes from home. I'm sure they are not legal...but hey, I wasn't legal for awhile either. Everyone does it "illegally" first for awhile to see if they can even get a small customer base going, worth becoming legal for. I have had prominent cake decorators/bakery owners tell me the same thing.

I could get all upset that I have other competition or I could just shrug it off and say "Hey my work speaks for itself" and just keep on doing what I'm doing.

I didn't read this whole thread so hopefully my post is on track. thumbs_up.gif

Now, I KNOW you CANNOT legally bake and sell from home in FL...the FL Dept of Ag website has it on there...but it's really difficult to understand.

Hey folks, had to throw my 2 cents into the pond. Listen... please stop to think before you post things. Opinions are always ok, right?

But this is a community of people with similar interests goals, and a desire to share techniques, support, etc...

This is no place to start fights. Words ALWAYS get misaligned. If you type "Got it." someone could automatically think you were being short and snippy, or even worse, rude. In real life, if you stand infront of a person who just finished telling you that your shoes have come unlaced, you smile, nod your head and say "got it". No snipiness or rudeness. Its just the inevitable because of the formality of typing.

One last thing back to the former law enforcement officer... :

-just as it is unfair for someone to justify their actions, it is also unjustifiable to lump an illegal home baker with a "massage parlor".

Everything in this world needs to have perspective and balance and you cannot compare the two.

There are crimes of nature (prostitution) , crimes of humanity (drugs, prostitution, child labor, kidnapping) and them crimes of law breaking - meant to keep us safe and orderly (no home bakeries in some areas, no painting your house bright red in some areas, no loose dogs, no garbage allowed to be dumped on the street), etc... Do you really think you can lump together a crime with a crime? Come now, back to my first point, stop and think before you post, ok?

If people are going to disagree on their perspectives we are all going to have to "agree to disagree". But being high-handed and pulling stunts like making posts about illegal bakers or doing other retribution-type things will only lower yourselves and your self-esteem.

Let's all take the advice of some of our wiser posters: let's pour our energy into doing right ourselves and not pointing fingers at what others are doing wrong. And let's not punish a minor crime by comparing it to dealing in stolen cars anymore.

If I was the competitor to this baker I would not worry about it.. If they get caught, then that is their problem.

I would not complain about it here.. Just call the Health Inspector and report them.. I would.. icon_cool.gif

I always thought of advertising as one of the "perks" of becoming legal. I dont think they should advertise but baking without a license is how most people get started.

That being said there is always a risk of someone turning them in, they should be prepared and aware of that.

Opinions are always acceptable in social situations.

But opinions cannot negate FACTS. (And Barbarooskie's arguement that she felt she wasn't acting in violation of the law is not true. (No matterly how strongly she voices her opinion, it will NEVER be true.)

I did not say an illegal home baker was the moral equivalent of a massage parlor. I observed that the behaviors demonstrated by Barbarooskie were the same. (You are assuming facts not in evidence. Any moral conclusions you draw are your own.)

Texas laws make it very difficult to get licensed at home. Your kitchen has to be separate from the rest of your house, as in, have a separate door, etc. I have heard of people building them in their garages for lots and lots of money.

I agree! Sheesh! Can we like....keep it light? This is a cake forum!! .... I mean LIVE AND LET LIVE and let's stop judging people. Sheesh! If we all went around quoting the law as "dispassionate observer and recorder of facts" we would all be tattle-tales like 6 year olds. Let's grow up peoples!

I have not engaged in any campaign to help or thwart either the legal or illegal bakers.

I have voiced no moral judgements or attempted to harass any members.

Appears when reason and logic cannot be refuted in an irrational/invalid arguement you switch your approach to repeat over and over again self-serving emotionally charged platitudes....and belittling childish insults.

Adult behaviour would entail assuming responsibility for our actions.

(It would be my personal opinion that you have a bias toward the illegal bakers, or else you wouldn't feel the need to attack me personally rather than address the logic (or lack thereof) in Barbarooskie's post.)

Having worked in law enforcement (and keeping up with the news, etc.) I have seen your arguement used as justification for crimes ranging from prostitution, and drug trafficking, to the employment of undocumented workers as well as an affirmative defense by drunk drivers.

Prostitution rings commonly advertise (misrepresenting their true nature) as either escort services, personal consultants or message parlors, etc., and their customers are willing participants.

Drug houses also only advertise by word of mouth (or using code/symbols in RAVE advertisements) and their customers don't care that their suppliers are illegal.

Undocumented workers never advertise, but their employers are complicit in their illegal employment.

Drunk drivers also never feel they've done anything wrong, and aren't made public until their behaviour is reported in the news (usually as the cause of a fatal accident).

All of the above would agree with your arguement, "I don't see anything wrong with that."

It is interesting to note that the famous rackateer, Al Capone, who listed his occupation as used furniture sales was not convicted of murder or bootlegging. No, he was convicted and sent to prison for tax evasion.

Moral judgments and personal biases are revealed in every comparison we make.

If you compare your new boss to Jack the Ripper you are telling the world how much you despise or fear the man. If you compare your new boss to Gandhi or Brad Pitt you are projecting a totally different vibe.

If you compare illegal bakers to prostitutes, drug traffickers and drunk drivers you are expressing one view; if you compare non-licensed bakers to jaywalkers you are expressing a different view all together.

Even word choice expresses an opinion or judgment. Do you use the term âillegal bakerâ or ânon-licensedâ baker? It is a clear indication of which side of the fence you are on.

So be aware of the comparisons and word choices you make, it reveals more about your opinions, judgment and attitudes than you think.
